DİYARBAKIR- Ankara 5th Administrative Court asked the Ministry of Interior, which left the application of his guardians to reveal Sheikh Said's burial place unanswered, to send all information and documents within 30 days.

 

Diyarbakir Bar Association, Sheikh Said Education Culture and Solidarity Association, Sheikh Said's grandson and guardian, Kasım Fırat, applied to the Ministry of Interior on February 15, requesting that the burial places of Sheikh Said and 46 of his friends, who were executed by the Eastern Independence Court in Diyarbakır in 1925, be disclosed. However, the Ministry did not respond to the application within the legal 30-day period.

 

The applicants applied to the 5th Administrative Court of Ankara on April 15 against the rejection decision of the Ministry, as not responding to the application legally meant the implicit rejection of the application. In their applications, the applicants requested the cancellation of the Ministry's refusal decision and requested that the execution of the decision be stopped.

 

'APPLICATION IS BASED ON INTERNATIONAL LAW'

 

The right to know the truth in the Additional Protocol No. 1 of  the Geneva Convention, "The Declaration of Disappearances", "The Convention on Disappearances", and the United Nations' Updated Principles on the Promotion and Protection of Human Rights through the Fight Against Immunity, The application made within the scope of the European Convention on Human Rights' freedom of thought and expression, with the obligation to take effective measures imposed on the states by the Declaration" was accepted by the court. The Ankara 5th Administrative Court, which accepted the application made on April 14, requested a defense from the Ministry of Interior on this issue. The court asked the Ministry to "send a certified copy of the transaction file containing all the information and documents related to the transaction in question".

 

MINISTRY MUST RESPOND

 

The ministry has to respond to the court, which requests information on April 28, within 30 days. After the ministry's defense, the court will examine the request for a stay of execution of its decision. In the event that the decision to reject the application for the disclosure of the burial places of Sheikh Said and his friends is stopped, the Ministry will have to disclose documents and information regarding the burial places of Sheikh Said and his friends.
